Consumer Rights – Right to Cancel – Cancellation and Return Conditions

GENERAL:

  1. If you place an electronic order through the website you are using, you will be considered to have accepted the pre-information form and the distance sales agreement offered to you.

  2. Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (RG: 27.11.2014/29188) and other applicable laws in relation to the sale and delivery of the product they purchased.

Unauthorized Use of Credit Cards for Purchases:

If it is determined that the credit card used by the buyer to pay for the product has been illegally used by unauthorized persons after the product has been delivered and the sale price of the product is not paid by the relevant bank or financial institution, the buyer must return the subject of the contract product to the seller within 3 days, with the shipping cost belonging to the seller.

IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE TIMEFRAME DUE TO UNFORESEEABLE CIRCUMSTANCES:

  1. If unforeseen circumstances occur and the product cannot be delivered within the specified time, the situation will be notified to the buyer. The buyer may request the cancellation of the order, the replacement of the product with a similar one, or the postponement of delivery until the obstacle is removed. If the buyer cancels the order, a full cash refund will be made within 14 days from the cancellation if the payment was made in cash. If the payment was made by credit card and the order is cancelled, the product fee will be refunded to the bank within 14 days, but it may take 2-3 weeks for the bank to transfer the fee to the buyer’s account.

If the buyer has a duty to check the product:

Duration of the right of withdrawal:

  1. The 14-day period for the right of withdrawal starts from the date of signing the contract if the item purchased is a service. In service contracts where the service has begun with the consumer’s consent before the expiration of the right of withdrawal period, the right of withdrawal cannot be exercised.

RETURN CONDITIONS:

  1. The SELLER is obliged to refund the total amount and the documents that put the BUYER in debt within 10 days of receiving the withdrawal notice, and to receive the returned goods within 20 days.

  2. If there is a decrease in the value of the goods due to a reason attributable to the BUYER, or if the return becomes impossible, the BUYER is obliged to compensate the SELLER’s damages in proportion to its fault. However, the BUYER is not responsible for changes and deterioration that occur due to the proper use of the goods or product within the period of the right of withdrawal.

  3. If the campaign limit amount issued by the SELLER falls below due to the use of the right of withdrawal, the discount amount benefited within the campaign scope will be cancelled.

Return rights cannot be used for products:

  1. Products made at the request or clearly for personal needs of the buyer and cannot be returned, such as innerwear, swimwear bottoms, makeup products, single-use products, goods with a possibility of rapid deterioration or expiration past the expiration date, products which are not suitable for return for health and hygiene reasons after the packaging is opened by the buyer, products that cannot be separated from other products after delivery, periodicals such as newspapers and magazines except for those provided under a subscription contract, services performed or non-tangible goods delivered instantly via electronic means, sound or visual recordings, books, digital content, software programs, data storage devices, computer supplies, and products where the packaging has been opened by the buyer are not eligible for return according to regulations. Also, the use of the right of withdrawal for services that have been initiated with the consumer’s approval before the expiration of the right of withdrawal period is not possible according to regulations.

  2. Cosmetic and personal care products, underwear products, swimwear, books, copyable software and programs, DVD, VCD, CD and tapes, and office supplies (toner, cartridges, ribbons, etc.) must be unopened, unused, unspoiled, and unused in order to be eligible for return.

Breach of contract and legal consequences
